I'm currently conspiring together with my associate of SKELETON PLAGUE RECS for our next release but we have a doubt concerning the fact of using a cover-track the band did for the tape which is from a well-known metal band...

So...how do you guys proceed on similar cases? do you ask the band to forget including cover-tracks or do you just go ahead with the releases as the band intend to and don't give a fuck?

If you are a musician who has recorded a cover version of someone else's song, you need to get a mechanical license authorizing you to reproduce their composition. You can find out who owns the copyright by contacting ASCAP, BMI, or SESAC. Then either contact the owner directly and negotiate your own rate, or contact the Harry Fox Agency and pay the prevailing statutory rate of 9.10¢ for songs five minutes or less, or 1.75¢ per minute or fraction thereof over five minutes.
For example:
5:01 to 6:00 = $.105 (6 x $.0175 = $.105)
6:01 to 7:00 = $.1225 (7 x $.0175 = $.1225)
7:01 to 8:00 = $.14 (8 x $.0175 = $.14)

If you are an underground label- fuck it.

If you are a small label that has distribution, barcodes, pay royalties, etc. then you need to pay mechanicals. (royalty to the songwriter- done through ASCAP, BMI, or SESAC)

I think only bands like Metallica or Abba can makes problems when you play covers without premission. I think its engouh when you just post info who orginally composed the track.

A common way for UG bands to escape this stuff is just to avoid mentioning the cover in the track list on the back side of the release (Apokalyptic Raids did it for example, and in their last release they mentioned the cover in very small red letters that can hardly be noticed near the big white letters in the rest of the track list).

There is an Unleashed cover we did on our myspace, and we were told by Century Media that if we ever put it on a cd, we will owe them almost as much for the cover as it costs to press the cds themselves.

i am tempted to just ask the band not to include the track. seems like the best way to go to avoid any potential problems.

First I'd ask directly from the band they're covering. If it's an old song, it might be, that the rights for the song belongs to the band or they've always belonged to them. And of course not all bands are part of the copyright-organizations, I personally hate those fags and refused to work with those people, so they don't have anything to do with my material.

Indeed, it's most likely impossible to contact them about the matter, but I really doubt Lemmy would give a shit about some cover-version and they've had material on shitload of labels, so most likely the label would be a problem either.

Just do it, it won't matter. Although just because a band member says it's OK, it still depends on what kind of contract they had with their label. With someone like Century Media or Nuclear Blast I'm sure if they find out they'll try to be assholes maybe since they usually own all publishing rights, which means it don't matter if Anders from Unleashed is cool about it. BUT, I think mechanical license is only necessary if it's 500 copies or more - if you want to be really technical.
